Last Steps, LLC — Website Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at laststepsdoula.com and all related pages (the “Site”), operated by Last Steps, LLC, a California limited liability company (“Last Steps,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

These Terms incorporate by reference our Privacy Policy, which explains how we handle information you choose to share with us through the Site.

2. About This Site — Not Medical, Legal, or Professional Advice

The Site provides general information about Last Steps’ end of life doula services. Nothing on the Site is, or should be relied upon as, medical, legal, financial, or other professional advice, and nothing on the Site is intended to diagnose, treat, or replace the guidance of a physician, hospice team, attorney, or other qualified professional. Laura Kandell’s role as an end of life doula is a non-medical role; her nursing and social work background informs her work, but she does not provide medical care through Last Steps.

Simply browsing or using the Site does not create a doula-client relationship, a professional relationship, or any other relationship between you and Last Steps.

3. Providing Personal Information to Communicate With Us

The Site allows you to request a complimentary consultation or otherwise reach out to us, including through the Contact page. In order to establish communication between you and Last Steps, you may elect to provide certain personal information, such as your name, email address, phone number, and any details you choose to share about your situation.

Providing this information is entirely your choice. Any personal information you provide through the Site will be collected, used, and retained in accordance with our Privacy Policy. Submitting this information does not, by itself, make you a client of Last Steps or obligate Last Steps to provide you with any services.

4. Becoming a Client

If you choose to engage Last Steps for doula services, that relationship — including the fees, scope of services, confidentiality obligations, and handling of any health-related information — will be governed by a separate written services agreement signed between you and Last Steps (the “Services Agreement”), and not by these Terms. If there is any conflict between these Terms and a Services Agreement you have signed, the Services Agreement will govern your relationship with Last Steps as a client.

5. Acceptable Use

You agree that you will not use the Site, including the Contact form or any other means of communicating with us through the Site, to:

• post, transmit, or communicate any content that is unlawful, threatening, harassing, abusive, defamatory, obscene, or otherwise objectionable;
• impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• attempt to gain unauthorized access to the Site, its underlying systems, or any account or data not intended for you;
• probe, scan, or test the vulnerability of the Site, or attempt to breach any security or authentication measures;
• interfere with or disrupt the Site or its servers or networks, including by transmitting any virus, malware, or other harmful code;
• use any robot, spider, scraper, or other automated means to access, collect, or index the Site or its content, other than standard search engine indexing;
• collect or attempt to collect personal information about any other person through the Site without their consent; or
• send unsolicited commercial messages (“spam”) through the Site.

We may restrict, suspend, or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms.

6. Intellectual Property

The text, images, photographs, and other content on the Site (collectively, the “Content”) are owned by Last Steps or used with permission, and are protected by copyright and other intellectual property laws. You may view and print Content for your own personal, non-commercial use. You may not copy, reproduce, republish, scrape, frame, or create a database from the Content, or use the Content for any commercial purpose, without our prior written consent. The “Last Steps” name and any associated branding are the property of Last Steps and may not be used without our permission.

7. Third-Party Links

The Site may from time to time contain links to third-party websites or resources. We do not control and are not responsible for the content, accuracy, or privacy practices of any third-party site. Your use of any linked third-party site is at your own risk and subject to that site’s own terms.

8. Site Availability

We aim to keep the Site available and functioning properly, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice.

9. Disclaimers

The Site and its Content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any warranty of accuracy, completeness, merchantability, or fitness for a particular purpose, to the fullest extent permitted by law. As noted in Section 2, nothing on the Site is medical, legal, or professional advice.

10. Limitation of Liability

To the fullest extent permitted by law, Last Steps and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your access to or use of, or inability to access or use, the Site, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to defend, indemnify, and hold Last Steps harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be brought exclusively in the federal or state courts located in the Northern District of California, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

14. Children’s Use of the Site

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 through the Site.
